Terms of Service

By accessing or using the ApiOne platform, API services, website located at apione.store, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access the Service. By creating an account or using the Service in any way, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

ApiOne provides a unified API platform that enables developers and businesses to access AI-powered data enrichment services including, but not limited to, company intelligence, people enrichment, email intelligence, signal detection, asynchronous job processing, and webhook delivery ("API Services"). Access to the API Services is provided on a credit-based subscription model. Credits are consumed per API call as specified in our pricing documentation. Unused credits do not roll over between billing periods unless explicitly stated in your subscription plan.

To access the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your API keys and account credentials. You agree not to disclose your API keys to any third party and to take sole responsibility for any activities or actions under your account. ApiOne reserves the right to refuse service, terminate accounts, or remove or edit content at its sole discretion.

Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan. All payments are processed securely through Paddle, our authorized reseller and Merchant of Record. By subscribing, you authorize Paddle to charge your payment method on a recurring basis. Prices are listed in USD and are subject to applicable taxes. ApiOne reserves the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing. Paddle acts as the Merchant of Record for all transactions. All billing inquiries, payment disputes, and refund requests related to payment processing should reference our Refund Policy.

API ONE may only be used for lawful business intelligence, CRM enrichment, market research, and data verification purposes. Users must have a legitimate business interest in any company or individual they enrich through the platform. API ONE must not be used to send unsolicited emails, build spam lists, conduct mass cold outreach campaigns, or harvest personal data without a lawful basis. All use of the Service must comply with applicable data protection and privacy laws, including GDPR, CCPA, and CAN-SPAM. Users are solely responsible for ensuring they have a lawful basis for processing any personal data submitted to or returned by the API. ApiOne reserves the right to suspend or terminate your account immediately for violations of this section.

The following uses are strictly prohibited: • Sending or facilitating unsolicited commercial messages of any kind • Violating CAN-SPAM, GDPR, or any applicable privacy law • Reselling enriched data to third parties without consent from the data subjects • Using the API to target individuals who have opted out of contact or requested erasure • Building contact lists for cold outreach to individuals you have no prior relationship with • Generating or augmenting spam lists or bulk cold email databases • Any automated scraping or data collection beyond the permitted API endpoints • Using the Service to build a competing product or service • Exceeding rate limits or attempting to circumvent usage restrictions Accounts found to be in violation will be suspended without refund. Repeated or egregious violations will be reported to relevant authorities.

API ONE processes data on behalf of users for the sole purpose of providing enrichment and intelligence services. Users are responsible for ensuring they have a lawful basis for enriching any personal data under applicable privacy regulations. You retain ownership of any data you submit through the API. ApiOne does not sell your data to third parties. ApiOne may use aggregated, anonymized data for product improvement and analytics purposes. For questions about data use, contact [email protected].

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy. You retain ownership of any data you submit through the API. ApiOne does not sell your data to third parties. ApiOne may use aggregated, anonymized data for product improvement and analytics purposes.

The Service and its original content, features, and functionality are and will remain the exclusive property of ApiOne and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ApiOne. You are granted a limited, non-exclusive, non-transferable license to access and use the Service solely for your internal business purposes in accordance with these Terms.

ApiOne targets 99.9% uptime for the API Services, measured monthly. Scheduled maintenance windows will be communicated with at least 24 hours' notice via the status page at status.apione.store. ApiOne does not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. In the event of service disruptions, ApiOne's sole obligation is to restore service as promptly as reasonably practicable.

To the maximum extent permitted by applicable law, ApiOne and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. ApiOne's total liability to you for any claims arising under these Terms shall not exceed the amount paid by you to ApiOne in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless ApiOne and its licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including any copyright, property, or privacy right.

You may terminate your account at any time by contacting support at [email protected]. ApiOne may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

ApiOne reserves the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email notification. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ApiOne is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
